OPINION
SCHRODER, Judge:
This is an appeal and a cross-appeal from an order dismissing an action against the Department of Employment Services and the Department of Personnel under the Kentucky Civil Rights Act alleging employment discrimination and retaliation. Upon reviewing the record and the applicable law, we agree with the lower court that the action was barred under the doctrine of election of remedies by the plaintiffs prior complaint filed with the Commission on Human Rights.
