OPINION AND ORDER

SIMON, District Judge.

Lars Erickson has sued Michael John Blake for copyright infringement of Mr. Erickson’s musical work, Pi Symphony. Mr. Blake has moved to dismiss the com*1134plaint for failure to state a claim upon which relief can be granted (Dkts. 1-10, 10). See Fed.R.Civ.P. 12(b)(6). For the reasons that follow, Mr. Blake’s motion to dismiss is granted.

BACKGROUND
