*57Respondent Bertram Brown was admitted to the practice of law in the State of New York by the Second Judicial Department on December 15, 1954. At all times relevant to this proceeding, he has maintained an office for the practice of law within the First Judicial Department.

On July 21, 2004, a complaint was referred to the Departmental Disciplinary Committee by the Queens County Surrogate that respondent misappropriated client funds amounting to $74,000 by commingling them with his private funds and disbursing them as his own.
