This is an appeal from an order granting a preliminary injunction restraining the defendant froin making, using, or vending the apparatus specified in claims 6, 7, 8, 12, and 16 of letters patent No. 495,443, granted April 11, 18ÍK?, to the administrators of Charles J. Van Depoele, assignors to the complainant, for *462“traveling contact for electric railways.” The application for the injunction was resisted upon the ground that the patent as to these claims was void, because the inventions covered thereby had been previously patented to the same inventor by letters patent…
