The case made in the bill is substantially as follows:

That in February, 1826, Peter Xarnall & Co. obtained a loan of .$2,100 from the Bank of Moimt Pleasant, and gave a single bill therefor, under seal, with the complainant, Richard Simms, Alexander Mitchell, and Z. Jacob, as *974sureties in fact, though they acknowledged themselves in the obligation as principal debtors.
