This is an appeal by the respondent below, Joseph Ciechirillo, Commissioner of the Division of Motor Vehicles 1 (hereinafter “DMV or “Commissioner”), of the February 12, 2009, final order of the Circuit Court of Marshall County in an administrative agency appeal. By the terms of the February 12, 2009, order, the revocation of the driver’s license of the petitioner below, James L.
