The petitioner in this case stands convicted *163upon his own confession in open court of the crime of murder in the first degree, and is now awaiting the execution of sentence of death awarded against him on such conviction at a term of this court for the county of Middlesex, held at the city of Lowell on the third Monday of April 1864. Under the provisions of Gen.
