Appeal from a judgment of the Supreme Court (Lamont, J.), rendered August 11, 2011 in Albany County, convicting defendant upon his plea of guilty of the crime of assault in the first degree.

Defendant was charged in a 10-count superseding indictment with, among other things, kidnapping in the first and second degrees, attempted murder in the second degree and assault in the first degree (two counts) stemming from an incident wherein he brutally attacked his wife, struck her head on a hard surface and inflicted significant injuries.
