Appeal by defendant (1) from a judgment of the Supreme Court, Kings County, rendered August 27, 1973, convicting him of assault in the third degree, upon his plea of guilty, and imposing sentence and (2) by permission, from an order of the same court, dated December 6, 1973, which denied his motion for resentence. Judgment and order affirmed.
