Proceeding under' article 78 of the Civil Practice Act (now CPLR, art. 78) to annul the determination of the Commissioner of Motor Vehicles revoking petitioner’s motor vehicle operator’s license because of his refusal to submit to a chemical blood test (Vehicle and Traffic Law, § 1194). By order of the Supreme Court, Rockland County, made October 14, 1963 pursuant to statute (CPLR 7804, subd. [g]), the proceeding has been transferred to this court for disposition.
