The defendant and one Baker were jointly charged by an information filed against them with the crime of murder, which consisted of having killed and murdered with malice aforethought, on July 10, 1924, in the county of Tehama, this state, one Samuel Hermanson. On the morning of the trial, and before the jury was impaneled, defendant Baker withdrew his former plea of not guilty and entered a plea of guilty of murder of the first degree and was subsequently sentenced upon said plea to life imprisonment in the state penitentiary.
