PER OURIAM.

Appellant being in default in the service of his -brief upon appeal, the appeal herein was deemed to be abandoned, and the judgment of' the trial court was affirmed in a decision reported in Conger v. La Plant, 153 N. W. 934. Appellant now applies to this court for a rehearing, and, to the end that such rehearing may be considered upon the merits of such appeal, he asks to be relieved from his default in the service and filing of a brief herein, and to be allowed 30 days within which to prepare, serve, and file such brief.
