Rickerson was indicted for the murder of Moseley and convicted of voluntary manslaughter. His motion for a new trial was overruled, and he sued out a writ of error to this court. *465He contends that neither under the evidence nor under the statement of the accused can a verdict of manslaughter be justified— that he is guilty of murder, or not guilty of any offense.
