OPINION

ZAMORA, Judge.

{1} Defendant, Jess Carpenter, appeals his conviction for involuntary manslaughter. Defendant argues that there is insufficient evidence to support the fourth element of the jury instruction given at trial — that he committed an unlawful act not amounting to a felony. Defendant also contends that the State’s failure to prove each element of involuntary manslaughter implicates his constitutional right to a jury trial.
