Plaintiff's claim for $27,378.54 against the failed Fayette Bank was allowed as preferred and defendants appealed.
The question is: Did the relation of debtor and creditor exist between the county and the bank, as to county funds on deposit at the time the bank closed on November 2, 1938? If such relation existed, plaintiff was not entitled to a preference.
