Will Eobertson was jointly indicted with West Eobertson for murder, but Will alone was tried. The jury returned a verdict finding him guilty, but recommended him to mercy. His motion for a new trial was overruled, and exception is taken to that judgment. Aside from the general grounds of the motion for a new trial as originally filed, the defendant filed an amendment containing five additional grounds.
