In early 2006, Defendant Mar-Comm & Associates, Inc. (“Mar-Comm”), a Florida corporation owned and controlled by John B. Marino, purchased 50 acres of real property in Buncombe County and began the process of developing the property as a residential subdivision. In the course of development, Plaintiff Young & McQueen Grading Company, Inc.
