OPINION

ELSA ALCALA, Justice.

Appellant, the City of Houston, appeals the trial court’s order that denied the City’s plea to the jurisdiction on quantum meruit claims brought by appellee, Swiner-ton Builders, Inc. 1 In a single issue, the City contends that Swinerton has failed to show a legislative waiver of the city’s im munity from suit, asserting that Swinerton cannot show a waiver of immunity for its quantum meruit claim based on a statute that waives immunity for claims for breach of contract. See Tex. Loc. Gov’t Code Ann. § 271.152 (Vernon 2006).
