The plaintiff, Sylvester H. McAllister, brings this action for damages allegedly sustained by him as the result of an automobile accident which occurred at about the hour of 9:30 in the evening on July 2, 1938, near the town of Livonia, in Pointe Coupee Parish. The plaintiff was riding on the rear seat of a Chevrolet coach automobile owned and being driven by one Allen T. Schully, when it collided with the rear end of a truck traveling in the same direction.
