This is an interlocutory appeal by the state following an order of the district court suppressing testimony concerning any pretrial or out-of-court identification of the defendant.

The case arose from a hit-and-run accident which occurred on June 18, 1976. Catherine Gerhardt, Donald Gerhardt, Connie Sullivan and David Sullivan were riding in an automobile when it was struck in the rear by another vehicle.
