BAKER, Judge. —

The appellant was convicted of murder, and his punishment assessed at life imprisonment in the penitentiary.

The appellant was charged by indictment with murdering Katie Goodman by shooting her with a pistol on or about November 16j 1926. The record discloses that at the time of the homicide the deceased was married to H. H. Goodman and was living with him in the city of Wichita Falls, and that the appellant was also married. It appears that before appellant married he boarded in the Goodman home and there grew up between deceased and appellant a strong attachment, which…
