delivered the opinion of the Commission of Appeals, Section B.
Plaintiff in error was struck and injured by an automobile belonging to defendant in error Winerich Motor Sales Company and driven by defendant in error Salinas on a public street in the city of Laredo. The jury found that the injury was caused by several acts of negligence on the part of Salinas, and that at the time of the accident Salinas was an employee of the motor sales company and not an independent contractor, and assessed the damages of $7500.00.
