The appellee’s decedent was in appellant’s serv*234ice as a section-hand, and was killed by being struck by one of the appellant’s passenger-trains, while he was engaged at work on the road, in the line of his employment. The accident occurred within the corporate limits of the city of Marion.

This action was brought by appellee, as administratrix of the estate of the decedent, for damages resulting from his death, which it is claimed was the result of the negligence of appellant’s servants in charge of its train.
