l noMF,s™1viien°not set, apart. — Rosalie Campbell was the owner of tbe real estate in controversy, and at tbe^time of her death itwasocenpied ^7 her and William P. Campbell, her bus-band, as tlieir homestead. • The said Rosalie executed a will, and, omitting notice of a bequest, which is immaterial, she thereby devised tbe real estate to Franklin Fearing, in trust, with directions to sell the same and *584pay tbe proceeds in equal portions to two of ber grand-children. The plaintiff is guardian of said children.
