Reversing in part and affirming in part.

The parties to this appeal were married in October, 1914. They separated in 1928, the wife taking their four small children to Tennessee. She procured a divorce in that state on February 15, 1929, on the ground of cruel treatment and failure to provide. Custody of the children was awarded to her. It appears that the husband was before that court on constructive service, and that he interposed no defense.
