MEMORANDUM OPINION

KAPLAN, District Judge.

Defendant moves to dismiss plaintiffs petition to confirm in part and vacate or modify in part an arbitration award on the ground that it was filed one day after the expiration of the ninety day limitations period of N.Y. CPLR § 7511(a).

Facts

Plaintiff and defendant were parties to an arbitration conducted by the National Association of Securities Dealers in 2003.
