The facts, in so far as they are pertinent to this decision, are, briefly stated, as follows-: The defendant agreed to lease certain premises from the plaintiff for a period of one year, with the privilege of renewal for two more. The defendant thereafter moved into the premises and opened a grocery store. At some time during the period of his occupancy, the plaintiff drew up and executed a lease embodying the terms of the agreement, and presented it to the defendant for his signature.
