In an action to recover damages for breach of contract, the plaintiff appeals from an order of the Supreme Court, Rockland County (Liebowitz, J.), dated December 19, 2006, which granted that branch of the defendant’s motion which was to dismiss the *501complaint pursuant to CPLR 3211 (a) (2) and denied his cross motion, in effect, for summary judgment on the issue of liability.
Ordered that the order is reversed, on the law, with costs, that branch of the defendant’s motion which was to dismiss the complaint pursuant to CPLR 3211 (a) (2) is denied, and the plaintiffs cross motion, in effect, for…
