As appears from the foregoing statement the action is to recover damages for breaches of the covenants of seisin and for quiet enjoyment and title contained in a warranty deed in ordinary form executed and delivered by defendant to plaintiff in 1926, which are alleged to have resulted from a resurvey and replatting by the United States government of the land described in the deed subsequent to its execution and the awarding of the greater part of the land to others than the plaintiff.
