The plaintiff instituted this action to recover $7,500 on an accident insurance policy issued on the life of Orlando Halliburton. The insured on October 14, 1931, about 4 o’clock p. m., registered in tho IVIineks Hotel in tho city of Tulsa, Okl., under an assumed name, and was assigned a room on the seventh floor of said hotel. He was escorted to the room by one of the bell boys at tbe hotel, and on entering the room he requested some iee water.
