HUNGATE, District Judge.

This matter is before the Court on the parties’ cross-motions for summary judg*126ment. There is no genuine issue as to material facts as the parties have stipulated to all facts pertinent to this dispute in a joint stipulation of facts filed on November 4, 1986. This cause is taken as submitted and summary judgment is in order.
