MORROW, Presiding Judge.

— The judgment condemns appellant to confinement in the penitentiary for a period of ninety-nine years for the offense of murder.

On December 4, 1921, Mary Keahey gave birth of an infant daughter called Sarah Lee Harper. The mother was the daughter of Mrs. Fannie Keahey, was unmarried, and resided with her mother at Sabinal. She had some months before the child was born taught school at a village in Uvalde County called Utopia, where the appellant lived and where she met him.
