RESCRIPT

BAKER, J.

This is an action at law brought to recover damages for breach of a certain contract and for the alleged mismanagement of a vessel. The plaintiff is a resident of the State of New York and the defendant a resident of the State of Massachusetts.

This action was commenced by writ dated May 5, 1926, by attaching certain funds, alleged to belong to defendant, in the hands of the Providence Washington Insurance Company in the city of Providence in this State. A prior action between the same parties and of exactly the same nature was begun by writ dated March 5, 1926, and…
