This is an appeal by the defendant Case, Pomeroy & Company, Inc. (hereinafter referred to as Case, Pomeroy), dealers in securities, and the defendant John C. Grunthert, an employee of Case, Pomeroy, from the unanimous judgment of the Appellate Division, third department, entered upon the submission of a controversy oil an agreed statement of facts, in favor of the plaintiffs and against defendants, for thirty dollars, the amount of a transfer tax claimed by the plaintiffs to be due upon the transaction which is recited in the agreed statement of facts.
