OPINION AND ORDER
LEISURE, District Judge.
Gianni Versace S.p.A. (“Gianni”) moves this Court pursuant to Federal Rule of Civil Procedure 41(b) to dismiss the remaining claims in this case as against Alfredo Versace (“Alfredo”) and L’Abbigliamento, Ltd. *31(“L’Abbigliamento”), in light of the poor financial conditions of Alfredo and L’Abbigliamento. For the reasons stated below, the motion is GRANTED.
BACKGROUND
