Hubbard Bros. Construction v. C. F. Halstead Contractor, Inc.
Supreme Court of Alabama
1Opinion of the Court
BLOODWORTH, Justice.
The sole question presented by this appeal is whether the trial judge erred in granting defendant’s motion for new trial. The motion contains the ground that the verdict is contrary to the great preponderance of the evidence. In ruling, the judge *690gave no reason for his decision. The evidence was in conflict. We say that he did not err and affirm.
The facts upon which this appeal rests are stated in the dissenting opinion of Mr. Justice Jones and need not be repeated here.
