WINTER, Circuit Judge:
Two weeks after his twenty-first birthday, Perry Hoo was indicted for violations of the Racketeer Influenced and Corrupt Organizations Act (“RICO”), 18 U.S.C. §§ 1961 et seq., 1962(c)-(d) (1982). Hoo moved to dismiss the indictment on the ground that the government’s delay in filing it denied him the protections afforded juveniles under the Federal Juvenile Delinquency Act, 18 U.S.C. §§ 5031-5042 (1982 & Supp. Ill 1985) and his rights under the due process clause of the fifth amendment.
