FACTS AND PROCEDURAL HISTORY

By orders dated March 13, 1996, this court entered summary judgment in favor of Brian Alan Peaceman and against PNC Bank N. A. in the amount of a certificate of deposit which was the subject of the dispute, together with accrued interest and denied PNC Bank N.A.’s *371cross-motion for summary judgment. PNC Bank N.A. appealed both orders to the Superior Court.

The crux of this dispute is a piece of paper, the original of which no longer exists because it was improperly and illegally redeemed by appellant. This piece of paper was a certificate of deposit…
