Jaycox, J.:

This is a very peculiar and interesting case. The facts are practically undisputed. The question that the jury was called upon to determine was the inference to be drawn from the facts.

*224The defendant was accused of having robbed one Frank Tierney of certain personal property. That the acts constituting the alleged robbery were performed by the defendant is undisputed.
