This is an appeal from an order of the circuit court of Eandolph county, at Moberly, sustaining respondent’s motion to affirm the judgment of a justice of the peace for want of notice of appeal. By section 7581, Eevised Statutes 1909, an appeal in a justice court, allowed ten days before the first day of the-next term of the circuit court, shall be determined at such term unless continued for cause. Section 7582, of said statutes, provides that if an appeal is not allowed the same day the judgment is rendered, the appellant shall serve the opposite party, at least ten days before the first…
