Plaintiff instituted this action, praying for the nullity of the judgment rendered by this Court in favor of the defendant and against him in the prior litigation between them (Gumbel v. New Orleans Terminal Co., 186 La. 882, 173 So. 518), on the ground that it appears that the judgment is null and void on its face, because it is pure judicial legislation, contrary to the express provisions of the pertinent Codal article and, therefore, denied the plaintiff “due process of law” and “equal protection of the laws” guaranteed to him by the Fifth and Fourteenth Amendments of the…
