This case arose out of an automobile accident which occurred on October 3, 1949, at about 7:40 p. m., at a point approximately twenty miles north of Deming, New Mexico, on U. S. Highway No. 260. The plaintiff, then of the age of five years, was riding with his family in an automobile driven by his father, Edward J.
