delivered the opinion of the Commission of Appeals, Section A.

This suit was instituted in the 117th District Court of Nueces County, Texas, by Nick Giannukes against James Sfiris to recover damages for personal injuries to the wife of Nick Giannukes, alleged to have resulted from the negligence of James Sfiris. The case was tried in the district court before a jury, but at the close of the testimony the jury was peremptorily instructed to return a verdict for Sfiris.
