BORAH, Circuit Judge.

This is an appeal from a final judgment of the District Court in favor of the plaintiff Archie Thornton and against the defendant Louisiana-Mississippi Pipeline Construction Corporation in an action in tort for damages.

On the night of September 7, 1950, plaintiff, an employee of defendant, while off duty and sleeping in a tent at the site of defendant’s pipeline construction job near Gulfport, Mississippi, was permanently injured when the tent caught fire and burned.
