This case presents us with David M. Lyons’s (“Lyons”) and United Transportation Union’s (“UTU”) appeal of the district court’s grant of summary judgment to defendant Norfolk & Western Railway Company (“NW”) (erroneously referred to as Norfolk Southern Railway in the complaint). Lyons and UTU sought to overturn an arbitration panel’s decision upholding NW’s decision to fire Lyons for allegedly failing to comply with a drug test administered by the company.
