Per Curiam : This case comes before the court on defendant’s motion, filed August 22,1975, requesting that the court *795adopt the recommended decision of Trial Judge Hal D. Cooper, filed June 19, 1975, pursuant to Rules 54 and 55, as the basis for its judgment in this case since plaintiff has filed no request for review by the court within the time set by the Rules therefor and such time has expired. Upon consideration thereof, without oral argument, since the court agrees with the trial judge’s recommended decision, as hereinafter set forth, it hereby affirms and adopts the recommended decision…
