Appellant sued appellee in the court of a justice of the peace for $300 damages for breach of contract of bailment, where there was a judgment for appellant. Appellee appealed to the circuit court, where a trial was had de novo which resulted in an instructed verdict for appellee, on the ground that the effect of the suit was one for fort, seeking to recover damages for negligent driving of appellant’s automobile, in a sum in excess of the jurisdiction of the justice.
