Levy, J.:
This is an action by the United States Trust Company of New York for the judicial settlement of its account as trustee under the last will and testament of Ella S. Hoffman, and for the construction of certain clauses of that instrument. The testatrix died on November 7, 1892. By article “ fourth ” of her will, she created a trust fund of $50,000 which will hereinafter be referred to as the Starkweather fund, with direction to the trustee “ to pay over to my mother, Lucinda R.
