Appeal from a judgment of the County Court of Broome County (Mathews, J.), rendered June 16, 1989, convicting defendant upon his plea of guilty of the crime of criminal possession of a controlled substance in the second degree.

Defendant was indicted for the A-I felony of criminal possession of a controlled substance in the first degree, and subsequently pleaded guilty to the A-II felony of criminal possession of a controlled substance in the second degree.
