The only question involved in the record of this cause is, whether in a suit by a non-resident, when the court below *97renders a decree against the defendant, and he takes an appeal to this Court, who reverse the decree below and award costs to the appellant, the undertaking required in such case by section 2 of chapter 138 of the Code binds the sureties only for the costs in the court below or also for the costs awarded by the Appellate Court.
